Your access to this website and use of any of the services provided by WellVibe is conditional upon your agreement and compliance with the terms and conditions rendered under the Service Agreement. You must not use our website or our services in any manner that violates any of these terms and conditions, is prohibited, or is unlawful.
WellVibe offers a wide range of professional services specifically designed to help individuals with disabilities. All the services will be carried out as per the terms and conditions set out in the Service Agreement with the client. Any changes required in the services must be presented in writing and should be notified before the commencement of services. WellVibe reserves the right to agree or disagree with the changes requested by the client at the relevant time.
WellVibe ensures its clients receive the care and services they have agreed upon in a timely and satisfactory manner, but the client acknowledges that there may be circumstances that are beyond our control. All our services, except those that may need medical interference, are provided by non-medical caregivers. The caregivers are not entitled to provide any medical assistance in cases of emergencies.
Payment for our services will be specified in the Service Agreement. By signing up with WellVibe, you agree to pay all applicable fees as specified in the expected time period. Failure to make payments as required may result in the suspension or termination of services. WellVibe reserves the right to change the payment terms and service costs at any time.
The client is responsible for informing WellVibe regarding the cancellation of any of the scheduled visits before 3 days / 72 hours of commencement of services. If the client fails to do so, WellVibe reserves the right to charge the client as per the Service Agreement. If WellVibe fails to designate a support worker as per the scheduled visits, no charge shall be debited for that particular visit.
WellVibe shall not be liable for any direct, indirect, incidental, special, consequential, or economic damages suffered by the client or the family of the client resulting from the use or inability to use our services. The client agrees that WellVibe is released from any such liabilities, and no claim shall be brought for the same.
WellVibe reserves the right to terminate or suspend its services or your access to the ongoing support at any time and for any reason, including but not limited to:
WellVibe is not liable to inform you about this termination. In the event of termination, you must immediately cease accessing and using our website and services.
By using our services or website or by violating any of the Terms and Conditions, you undertake to indemnify, defend, and hold us harmless from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) that arise by using our service, support or website.
These Terms and Conditions shall be governed by and construed in accordance with the laws of NDIS safe guards. Any disputes arising out of or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of Australia..
